Art. 188 provides for criminal penalties of imprisonment for not more than three years or a monetary penalty for any person who sexually exploits his or her relationship with a minor over the age of 16 (which is the age threshold for statutory rape under Penal Code Art. 187) who is dependent on him or her due to a relationship arising from the minor's education, care or employment or another form of dependent relationship, or for any person who encourages such a minor to commit a sexual act by exploiting such a relationship.
